Q. Andy from Dallas, TX, asks, "I am getting divorced. Will my soon-to-be ex-wife be due any of pension I earn after our divorce?"
A. Spencer Olsen from Pension Evaluators & QDROS Of Troyan, Inc Associates
Group, answers, "It actually depends on the state which the divorce is in. In many
states, the spouse's interest in the pension ends with the divorce,
so the benefits that would be accrued over the remainder of the time in
the Plan would be solely yours. In other states, the additional accrued
benefits would add on to the previously accrued benefits, and she may
be entitled to a portion of those."
