Brett Disdale from Pension Evaluators & QDROS Of Troyan, Inc Associates Group, answers, "This is an unusual circumstance because the QDRO is essentially an agreement between the two parties, but this situation does arise quite frequently. If the parties don't agree on the terms of the QDRO, the judge makes the final determination and can enter the order even without consent from both parties, and he can order a party to sign the QDRO even if they disagree with it as well.
